Heard Sri K. N. Misra, learned counsel for the petitioner and learned Standing counsel for the opposite parties. Petitioner submits that her husband died on 9. 5. 2008. Petitioner was legally weeded wife of the petitioner and she applied for employment under dying in harness rules. Relevant documents were asked for and have been supplied by the petitioner. Learned Standing counsel states that the name of the petitioner does not occur in the service book where the name of the earlier wife is available. Learned counsel for the petitioner submits that this is not a sufficient ground because earlier wife has already denied. The dispute regarding legal heir ship, if any, has to be decided by the opposite party No. 2 itself under the rules. Therefore, it is directed that the complaints, if any, have been filed by the legal heirs of the petitioner, the opposite party No. 2 will look into the matter and pass appropriate orders within a period of two months from the date of receipt of a certified copy of his order. It is clarified that this Court has not expressed any opinion on the merits of claim of any of the party. With these observations the writ petition stands finally disposed of. .
