Judgment :- 1. This petition has been filed seeking for a writ of Mandamus to call for the records of the Respondent, in BU/R/A1-C/2009/882(VC), dated 08.06.2009, directing the petitioner not to admit the students for the academic year 2009-2010, until the explanation was submitted, with regard to the advertisement dated 15.05.2009, relating to the admission of the students of the petitioner college, for the academic year 2009-2010. 2. The main objection of the respondent is relating to that portion of advertisement, wherein it had been stated that the petitioner college will admit the students, those who have written the first year examination in other colleges to the second year course in the petitioner college, on payment of Rs.1,500/-. 3. The learned counsel appearing on behalf of the respondent had submitted that this portion of the advertisement would be misleading and would be contrary to the rules and the regulations applicable for the admissions. 4. Heard the learned counsel for the petitioner and also the learned counsel appearing on behalf of the respondents. This court has gone through the affidavit of undertaking that has been filed before this court, which is as follows: UNDERTAKING AFFIDAVIT OF A. VISWANATHAN I, Viswanathan, son of Arunachala Gounder, Hindu, aged about 62 years, residing at Kottai Thottam, Avinashipalayam, Koduvai , Tirupur District, since come down to Chennai do hereby solemnly affirm and sincerely state as follows:- 1. I am the petitioner herein and as such I am well acquainted with the facts of the case. I am the Chairman of A.G.Trust and also A.G.Arts and Science College for Women formed by A.G.Trust. 2. I humbly submit that I have not made any admission pursuant to the Advertisement dated 15.05.2009 in "Daily Thanthi". I will make admission only on the basis of the Advertisement dated 25.05.2009 and abide all rules and regulations of the University in letter and spirit. 3. I hereby undertake that I will not make any admission pursuant to the Advertisement dated 15.05.2009 in "Daily Thanthi". In future also I will not do any advertisement as like as the advertisement dated 15.05.2009. Solemnly affirmed at Chennai,) he signed his name in my presence) on this 18th day of June 2009) 5. 3. I hereby undertake that I will not make any admission pursuant to the Advertisement dated 15.05.2009 in "Daily Thanthi". In view of the above undertaking of the petitioner college, the learned counsel appearing on behalf of the respondents had submitted that no action would be initiated against the petitioner college, based on the advertisement, dated 15.05.2009. Hence, the Writ petition stands closed. However, it is open to the petitioner college to admit the students based on the advertisement, dated 25.05.2009, by complying with the rules and regulations, applicable for such admissions.
