Order The present writ petition has been filed for issuance of an appropriate writ/ order/direction commanding upon the respondents to give to the petitioner 1st time bound promotion w.e.f. 10.11.1986 to the post of Bihar Education Service Class Junior Selection Grade and further be pleased to direct the respondents to give promotion to the post of Senior Selection Grade as the persons junior to the petitioner have already been promoted earlier and further be pleased to direct the respondents to pay the differences of retiral benefits to the petitioner as the petitioner has retired on30A.2000 from the post of District Education Officer and further be pleased to direct the Respondents to fix the pension on the basis of revised scale. 2. Initially a writ petition was filed vide C.W.J.C. No. 1497/95(R) (Annexure3) wherein it has been stated that "In paragraph 4 of the counter affidavit, the District Superintendent of Education Ranchi has stated that the petitioner's case for promotion was considered but due to some pending allegation the same cannot be given effect to. 3. Upon query, I have been informed that no disciplinary proceeding has been initiated nor any order has been passed and the petitioner has retired in the year 2000. 4. In the light of the aforesaid facts the claim of the petitioner prima facie appears to be correct. 5. Considering the aforesaid facts and circumstance of the case Respondent No. 3, is directed to take a decision and pay the admissible dues which he would have been entitled to pursuant to his promotion which was denied and communicate the same to the petitioner. 6. It goes without saying that the admissible dues should be paid within a period of two months from the date of receipt/production of a copy of this order. 7. This writ petition is accordingly disposed of.
