Judgment L.N.Mittal, J. 1. Respondent has been served through his counsel in the lower court, but none has put in appearance on behalf of the respondent. 2. Heard. File perused. 3. Smt. Shallu has filed this transfer petition under Section 24 of the Code of Civil Procedure (in short, C.P.C.) for transfer of petition under Section 9 of the Hindu Marriage Act, 1955 instituted by respondent-Rahul Nahar from the Court of Smt. Sneh Parasher District Judge, Family Court, Faridabad to any Court of competent jurisdiction at Ludhiana. 4. It is alleged in the application that the petitioner is residing at Ludhiana along with two minor sons aged about 3 years and about 1 year born out of the wed-lock, and therefore, it is highly inconvenient for her to defend the aforesaid petition at Faridabad because distance between Faridabad and Ludhiana is said to be about 350 Kms. 5. In view thereof, it is apparent that it would be difficult for the petitioner to defend the aforesaid petition at Faridabad. The aforesaid plea of the petitioner stands uncontroverted. 6. As per judgments of Honble Apex Court, convenience of the wife has to be preferred in such cases. 7. In view of the aforesaid, the instant transfer petition is allowed and petition titled as Rahul Nahar v. Smt. Shallu filed under Section 9 of the Hindu Marriage Act, 1955 is transferred from the Court of Smt. Sneh Parasher, District Judge, Family Court, Faridabad to the Court of learned District Judge, Ludhiana, who shall be at liberty to keep the case with himself or to assign the same to any Additional District Judge, Ludhiana. Order accordingly.
