JUDGMENT 1. 1. Heard learned counsel for the parties. Perused the impugned order Annexure-1 by which the application submitted by the petitioner for being released on second parole under Rule 9 of the Rajasthan Prisoners (Release on Parole) Rules, 1958 (hereinafter called the Rules of 1958 Rules), has been refused on the ground that reason which has been given by the applicant for being released on parole for taking part in the marriage celebration of his son has been found to be false. 2. Apart from the above, nothing adverse has been reported against the petitioner by the jail authorities who have otherwise certified that conduct of the petitioner has been satisfactory. It has also not come on record that petitioner, who was enlarged on first regular parole, in any way mis-used the liberty granted to him. In the facts and circumstances, taking in to account the judgment of the Division Bench of this Court rendered in Budhi v. State of Rajasthan reported in, 2006(1) WLC (Raj.) page 27 , where this Court has drawn a distinction between regular parole under Rule 9 and emergent parole under Rule 10(A) and held that it is not necessary in all cases for the prisoner to assign any specific reason for being enlarged on regular parole under Rule 9 as distinct and emergent parole under Rule 10A. 3. Since the petitioner in the instant case had applied for second regular parole for 30 days under Rule 9, it was not at all necessary for the petitioner to have given any specific reason for being enlarged on parole. 4. In that view of the matter, we are inclined to accept this writ petition and direct that the petitioner be released on second regular parole for 30, days on the usual terms and conditions to be imposed by the Superintendent, Central Jail, Jaipur. 5. Consequently, this writ petition is allowed. The petitioner Harbaksha Ram s/o Kishna Ram is directed to be released on second regular parole for 30 days by the Superintendent, Central Jail, Jaipur, on his furnishing a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each. The Superintendent, Central Jail, Jaipur, shall also fix a date for the surrender of the petitioner before the Jail Authority.Writ Petition Allowed. *******
