Judgment : Prayer: Petition filed seeking for a writ of Mandamus, directing the nature of a writ directing the 1st respondent to consider the application made by the petitioner college dated 10.07.2009 for continuation of Affiliation for the academic year 2009-2010. By consent of both the parties, the writ petition is taken up for hearing and disposal. 2. This writ petition has been filed praying for a writ of Mandamus to direct the 1st respondent to consider the application made by the petitioner college, dated 10.07.2009, for continuation of Affiliation for the academic year 2009-2010. 3. The learned counsel Mr.Mani Sundar Gopal, takes notice on behalf of the first respondent and the learned counsel Mr. Muralikumaran,takes notice on behalf of the respondents 2 and 3. 4. It has been stated that the petitioner is running an educational institution sponsored by Vengammal Educational and Chartiable Trust, for educating the students hailing from remote villages. The petitioner college has commenced functioning from the year 2001 and it has been getting approval from the appropriate authorities for conducting various courses. Whileso, the authorities concerned had granted affiliation to the petitioner college, for the academic year 2008-2009. However, no application had been submitted by the petitioner college for affiliation for the year 2009-2010, due to the reason that the first respondent had stopped the admission process for the academic year 2009-2010, for the various courses in the petitioner college and the affiliation for the academic year 2009-2010 had also been suspended by the order, dated 12.05.2009. Since the petitioner college had complied with all the requirements and had also rectified the deficiencies, it has submitted an application, dated 10.07.2009, for continuation of affiliation for the academic year 2009-2010. 5. Mr.R. Manisundar Gopal, the learned counsel appearing on behalf of the first respondent, had submitted that the last date fixed by the syndicate of the first respondent university, for considering the application for affiliation for colleges, is 10.01.2009. Therefore, the application of the petitioner college, dated 10.07.2009, is belated in nature. However, it is for the syndicate of the first respondent university to decide the issues raised in the application for affiliation of the petitioner college for the academic year 2009-2010, in accordance with law. 6. The learned counsel for the petitioner had submitted that even though the application of the petitioner college, dated 10.07.2009, had been made belatedly, this court may be pleased to direct the first respondent to consider the application, in accordance with law, by placing it before the syndicate of the first respondent University, as early as possible, in view of the urgency involved in the matter. 7. In view of the special circumstances prevailing, with regard to the grant of the affiliation of the petitioner college for the academic year 2009-2010 and in view of the submissions made by the learned counsels appearing on behalf of the petitioner, as well as the respondents, the first respondent is directed to consider the application of the petitioner college, dated 10.07.2009, for continuation of the affiliation for the academic year 2009-2010 and pass appropriate order thereon, in accordance with law, as expeditiously as possible. 8. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter. 9. The writ petition is disposed of accordingly. No costs. Consequently connected M.P. is closed.
