JUDGMENT Honble B.N. Shukla, J. —Heard learned counsel for the applicant, learned A.G.A. and perused the record. 2. It is contended by the learned counsel for the applicant that the applicant is Junior Engineer and he was tenant in the house of the complainant and has been falsely implicated in this case and on the date of alleged occurrence the applicant was present on duty and certified copy of the attendance register has been filed to this effect. The applicant is in jail since 17.7.2009. 3. Learned A.G.A. has contended that the applicant was involved in kidnapping the daughter of the complainant who has still not been recovered. 4. The applicant has no criminal history. Perused the certified copy of the attendance register. The applicant was tenant in the house of the complainant. 5. Considering nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering of the witnesses and prima facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail. 6. Let the applicant Rajeshwar Vishwakarma involved in Case crime No. 361 of 2009, under Sections 363, 366, 506, IPC and 3(1)(x) SC/ST Act, P.S. Civil Lines, District Etawah be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned. ————
