Judgment :- M. Chockalingam, J. Memo of compromise has been filed by both appellant and the respondent. The appellant and the respondent were also present and agreed for the terms of compromise which reads as follows: "(a) The Appellant hereby acknowledges that the respondent has not infringed the copyright or IP right of BM with regard to the phone "phone validation" service. (b) Both the parties herein agree and acknowledge that the technology/ process "phone validation" of the Appellant (Consim India Pvt. Ltd.) and "My contact details" of the Respondent (People Interactive India Pvt. Ltd.,) are developed and conceived by the parties independently. (c) The Appellant agrees to withdraw the Appeal and suit filed against the respondent in the High Court of Madras bearing OSA.Nos. 407 & 408 of 2008 and C.S.No.288/2007. (d) The parties shall bear their own costs." Memo of compromise is recorded. The O.S.As. are disposed of in terms of Memo of compromise entered into between the parties. No costs. Consequently, M.P.Nos.1 & 1 of 2008 are closed.
