Judgment :- This writ petition is filed for issue of a Writ of Mandamus directing the respondents to regularise the service of the petitioner on and from 3. 1997, the date of joining service as teacher and further direct the respondents to promote the petitioner to the post of Elementary Grade Headmistress. 2. Learned counsel for the petitioner has brought to the notice of this Court that the petitioner was appointed on compassionate grounds and only the Government is the competent authority to regularise the service of the petitioner. Consequently, proposals were submitted to the 1st respondent by the Director of Elementary Education by letter dated 25. 2009 and as on date, the matter is pending before the 1st respondent. The said proposal is also annexed at Page No.23 of the typed set of papers. 3. Since the matter is pending before the 1st respondent, taking note of the fact that the petitioner is continuing in service from 1997 without any regularisation, thereby depriving her from enjoying the benefits which a regular employee is entitled to, the writ petition is disposed of directing the 1st respondent to consider the case of the petitioner, as submitted by the Director of Elementary Education, by letter dated 25. 2009 and pass orders on the same, within a period of 12 weeks from the date of receipt of a copy of this order. No costs. Connected M.P. is closed.
