JUDGMENT: Uma Nath Singh, S.N.H. Zaidi,J. Affidavit of Sri Prem Prakash,? Senior Superintendent of Police/D.I.G., Lucknow, filed in Court is taken in record. As per averments made in the affidavit, there is a categorical denial of allegation made in the telegram. We notice that in all such matters, police is coming with? denial statements of detenus or their family members without proper verifications of its contents. Hence, we direct the Home Secretary, Government of U.P. to issue necessary instructions that in such cases, the alleged detenus shall? be produced before the? Judicial Magistrate concerned and the affidavit of the Superintendents of Police shall be supported by the? statements recorded by Magistrates. With the? aforesaid directions, this writ petition stands disposed of.
