Judgment :- This civil revision petition is filed for a direction to direct the Family Court, Coimbatore to dispose of the HMOP No.321 of 2005 pending on its file. 2. Heard the learned counsel for the petitioner. Despite printing the name of the respondent, she has not appeared either in person or through her Advocate. 3. Avoiding discursive discussion, I would like to set out the relevant facts, which are absolutely necessary and germane for the disposal of this civil revision petition, thus: The revision petitioner herein filed HMOP No.321 of 2005 seeking divorce as against his wife, the respondent herein. The grievance of the petitioner is that despite the HMOP having been ripened for enquiry, no progress at all has been made in the proceedings. Hence, this civil revision petition. 4. When this Court raised a question as to whether any arrears of interim maintenance are payable by the petitioner herein in favour of the respondent, the learned counsel for the revision petitioner would submit that there is no order passed by the Family court relating to interim maintenance. 5. Be that as it may, since the petitioner wants early disposal of the HMOP, in commensurate with the provisions of the Hindu Marriage Act, the Family Court, Coimbatore shall do well to see that the HMOP is disposed of on merits within a period of three months from the date of receipt of a copy of this order. It is also made clear that if there are any arrears of interim maintenance payable by the petitioner to the respondent, the same shall be enforced by the Family Court, Coimbatore in accordance with law. 6. With the above observation, this civil revision petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
