JUDGEMENT Ajay Kumar Tripathi, J. 1. Heard learned Counsel for the parties. 2. A counter affidavit has been filed on behalf of respondent Nos. 2 to 4 which is B.R.A. Bihar University where the stand has been taken that petitioners claim for a sum of Rs. 1,24,003/- under five different heads have been taken into consideration and a demand raised on the State Government along with the claim of all such persons having worked under separate Constitute Colleges which now falls under the J.P. University. A request has been made to the State Government to release fund in favour of J.P. University itself since all these colleges are now under the J.P. University and the J.P. University is even in better position to disburse the outstanding claims. In support of the averment they have brought on record by way of Annexures- A & B to the counter affidavit. 3. Taking the above position stated in the counter affidavit since the payment to the petitioner is incumbent upon the release of fund by the State Government, this writ application is disposed of with a direction that when these funds are released either in favour of the J.P. University or in favour of the B.R.A. Bihar University steps will have to be taken by the University concerned to pay to the petitioners balance outstanding dues of Rs. 1,24,003/- within a period of three months from the date of such release of the fund. If the petitioner has any other claim he has freedom to approach the University concerned for release of that amount though as per the averment in the counter affidavit filed by the J.P. University all the claims made as such have already been released in favour of the petitioner. 4. This writ application stands disposed of with the above direction.
