body2009
Judgment :- D. Murugesan, J. In view of the limited relief sought for in the writ petition, we directed Mr. Ramanlal, the learned counsel appearing for the Tamil Nadu Pollution Control Board, to take notice. 2. The only grievance of the petitioner is that the penalty amount to be remitted by the petitioner could not be paid in one instalment. Hence, the petitioner seeks for payment of the said penalty amount in ten instalments. 3. The learned counsel appearing for the petitioner would rely upon a similar order passed by this Court in W.P.No.9350 of 2008, dated 24. 2008. 4. In view of the above, we direct the following: The total amount of Rs.4,50,000/- shall be paid by the petitioner towards the penalty in ten equal monthly instalments, first of which shall be payable on or before 30.9.2009 and the subsequent instalments shall be paid on or before the last working day of every month. 5. We make it clear that in the event, the petitioner commits any default of even one instalment, the Tamil Nadu Pollution Control Board is entitled to take action in accordance with law. It is also made clear that the period of the instalments granted in this order shall not be extended for any reason whatsoever. 6. Accordingly, the writ petition is disposed of. No costs.
