JUDGMENT : 1. The Petitioners have filed this application u/s 482 Code of Criminal Procedure. for quashing the F.I.R. dated 26.1.2009 which was registered as Handapa P.S. Case No. 15 of 2009 corresponding to C.T. Case No. 131 of 2009 pending before the Learned S.D.J.M., Athamalik. 2. It appears from the record that the offences alleged against the Petitioners are under Sections 341/294/307/506/34, Indian Penal Code. 3. As per direction of this Court vide its Order Dated 22.4.2009, the statement of the informant-Manoj Kumar Pradhan has been recorded u/s 164 Code of Criminal Procedure. by the Learned S.D.J.M., Athamalik in C.T. Case No. 131 of 2009. 4. Perused the statement. It reveals from the statement recorded u/s 164 Code of Criminal Procedure. that the dispute has been amicably settled with the Petitioners. Therefore, the informant does not want to proceed with matter. 5. The proceeding of the aforesaid C.T. Case if continue till end of the trial, the chance of conviction of the accused persons would be very bleak and in such a situation, the time that would be consumed in the proceeding would be only an abuse of process of the Court and no useful purpose would be served by allowing the said case to continue till end of the trial. 6. Therefore, taking into consideration the above facts, this Court for ends of justice and in exercise of the power u/s 482 Code of Criminal Procedure. and in view of the decision of the Apex Court in the case of Manoj Sharma v. State and Ors. reported in 2009 (42) OCR (SC) 144, quashes the further proceedings in C.T. Case No. 131 of 2009 pending before the Learned S.D.J.M., Athamalik. 7. The CLRMC as well as Misc. Case is accordingly disposed of. 8. Urgent certified copy of this order be granted on proper application.
