JUDGMENT 1. 1. As per resolution of the respondent Board options were called from the employees to opt for pensionary benefits or Provident Fund Scheme vide order dated 27.02.1991. In pursuance of the above order, the appellant gave his option for Provident Fund Scheme vide his letter dated 18.05.1991. Subsequently, it appears that another order was issued by the respondent Board on 24.07.1992 calling for further options. However, the above order dated 24.07.1992 had been recalled by the respondent Board vide order dated 08.04.1993. The appellant continued under the Scheme as per his option given on 18.05.1991. It was only on 21.12.1996 that the appellant filed a writ petition before this Court challenging the impugned action of the respondent Board in recalling the order of calling for second option. 2. After having carefully gone through the material on record, since after due consideration proper discretion has already been used by the learned Single Judge, we find no error or illegality in the impugned order dated 25.02.1999 so as to call for any further interference. 3. The appeal is dismissed accordingly as having no merits.Appeal Dismissed. *******
