ORDER 1. Heard learned counsel for the petitioners and the State. 2. Whenever a Government servant appears before the Court in the capacity of an accused to a limited offence, he should be given some liberty on the point of his remaining presence but he never can be given, this liberty to misuse his status. In the instant case, date was fixed for evidence, witness was also in presence and on that accused persons did not come rather filed a representation only to adjourn or linger the case for initiating no steps by lawyers disentitles the accused petitioners for any liberal view. Only liberty which can be given to the petitioners is to appear in the proceeding before the Court below and seek bail then only it will be for the Court to allow them on bail imposing some conditions for remaining their physical presence or if representation is filed then for taking initiative for steps required. 3. The petition is thus dismissed.
