JUDGEMENT 1. Heard learned counsel for the appellant and learned counsel appearing for the respondents. 2. It is the case of the appellant- petitioner that he was appointed along with two others, namely, Kameshwar Kumar Kamal and Chandrabhushan Kumar as untrained Assistant Teachers by the Managing Committee of the Primary School, Jajauri, Anchal -Mahishi, District-Saharsa, a copy of which can be seen from Annexure-1 to the writ petition. 3. The Primary Schools were taken over by the Government as per the Bihar Non-Government Elementary Schools (Taking over of Management and Control) Act, 1976. Accordingly, the services of the appellant-petitioner was taken over, as can be seen from Annexure-5 to the writ petition. 4. It is the case of the appellant- petitioner that the Government in the Human Resources Development Department, Bihar communicated the decision of approval of the services of the appellant- petitioner along with Kameshwar Kumar Kamal and Chandrabhushan Kumar by Letter No. 3286 dt. 29.12.1988, which is marked as Annexure-1 to the Memo of Appeal. It is further submitted that even though Kameshwar Kumar Kamal and Chandrabhushan Kumar were paid salary but even after rendering satisfactory services for all these years, the petitioner- appellant was not paid salary, for which he repeatedly filed representations before the concerned authority but the efforts remained in vain and thus the petitioner was constrained to approach this Court. 5. In these circumstances, we direct the appellant-petitioner to file a representation to the Respondent No. 2. Director, Primary Education, Govt, of Bihar, Patna, with a copy of all the necessary documents and. if such a representation is filed within two months from today, it shall be considered and disposed of by the Respondent No. 2 within three months from the date of receipt of a copy of this order alongwith the petitioners representation with a notice to the petitioner. 6. With the above direction, the appeal stands disposed of.
