Again, this matter was listed before this Court on 111. 2009, the learned counsel appearing for the appellant requested time and the matter was adjourned accordingly. Subsequently, the matter was listed on 211. 2009, the learned counsel appearing for the appellant has not appeared and the matter has been adjourned. 2. Thereafter, the matter was listed today for admission. Even today, neither the appellant nor the counsel is not present and prosecute the matter. Therefore, this appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is also closed. No costs.
