JUDGMENT 1. - This order governs the disposal of bail petition filed by Shri Vijay Khandelwal, Advocate on behalf of the applicant Banwari son of Babu Lal Meghwal pertaining to F.I.R. No. 01/2009 of Police Station Atru, District Baran in the offences under Sections 457 & 380 of IPC.Heard learned counsel for the petitioner as also the learned Public Prosecutor for the State and perused the record of the case. 2. Learned counsel for the petitioner has canvassed that he has been falsely implicated in this case. So far as the so called recovery of articles from his possession is concerned, the police has shown false recovery, whereas he did not furnish any information under Section 27 of the Indian Evidence Act. The offences wherein the petitioner is alleged to have been Involved are triable by the court of Judicial Magistrate First Class. He has been In custody since 6.1.2009. No other criminal case is pending against him. Trial of the case shall take time, as such he may be granted indulgence of bail. 3. Learned Public Prosecutor has opposed the bail petition on the ground that stolen gold and silver articles have been recovered at the instance of the petitioner. Hence, he should not be given bail. 4. Having considered the submissions made at the bar and perused the relevant material on record carefully, it is noticed that some gold and silver ornaments are found to have been recovered at the instance of the petitioner. No recovery of cash has been made from him. The case is pending trial which is likely to take time. Hence, keeping in view the facts and circumstances of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.PC. 5. It is, therefore, ordered that the accused-petitioner namely Banwari son of Shri Babu Lal Meghwal in FIR 01/2009 Police Station Atru District Baran shall be released on bail on furnishing a personal bond of Rs. 1,00,000/- (Rupees one lac only) together with two local sureties bonds each of Rs. 50,000/- to the satisfaction of the learned trial Court with the stipulation that he shall appear before that Court on all dates of hearing and as and when called upon to do so till the trial is concluded.Bail Application Allowed. *******
