ORDER : 1. The Special Leave Petition as well as the Writ Petition arising out of the judgment of the learned Single Judge of the High Court dated 31st October, 2007, Bihar Education Service Assn. v. State of Bihar, CWJC No. 10091 of 2006, order dated 31-10-2007. (Pat) shall stand disposed of by this common order :- 2. During the course of the hearing of these matters we have been informed by the learned counsel appearing for the State of Bihar that some of the members of the Association have already filed Letter Patent Appeals against the impugned order of the learned Single Judge before the High Court which are pending for consideration and final decision. In that view of the matter, we are not inclined to interfere with the impugned order of the learned Single Judge at this stage. 3. However, the petitioners before us in these proceedings are at liberty to approach the High Court by way of LPA(s) which shall be filed by them within two weeks from today. If the petitioners file LPA(s) within the stipulated period, the High Court is requested to entertain the same without reviving the issue of limitation and shall make endeavour to hear and decide all the appeals together within three months from the date of this order. Needless to say that the appeals shall be heard and decided on their own merits as we have not embark upon the merits of the cases filed before this Court. The contempt proceedings said to have been filed and pending before the High Court, shall also be heard and decided by the Division Bench of the High Court along with the LPAs. 4. The Special Leave Petition as well as the Writ Petition stand disposed of accordingly. 5. Learned counsel appearing for the applicants in I.A. No. 4 and I.A. No.5 pray for leave to withdraw these applications. Permission granted. I.A. Nos. 4 and 5 therefore, are dismissed as withdrawn.
