ORDER : H.S. Bedi, Aftab Alam, JJ. None present for the appellants. Mr V. Shekhar, learned counsel for the respondent has pointed out that even on the last date of hearing no counsel had appeared on behalf of the appellants. He has also brought to our notice the order of the High Court dated 16-1-2002 Videocon International Ltd. v. Union of India, WP (OS) No. 2625 of 1988, order dated 16-1-2002 (BOM) directing the respondents herein to adjudicate upon the question as to the payment of duty on the consignment exported by the appellants within four months from the date of receipt of an order of the High Court. As this period has long since expired it appears that the appellants are not interested any further in this matter. 2. In this background we dispose of this appeal as having become in fructuous but with a liberty to the appellants to re agitate the matter if the need so arises. 3. The appeal is disposed of accordingly.
