Order The present petition has been preferred for getting arrears of salary including salary for February, 2006, pension and arrears of pension, leave encashment of 300 days, provident fund, gratuity, interest on the above @ 10% per annum apart from statutory interest and costs. The petitioner has retired on 31st October, 2008 from the post of Head Clerk, Sadar Hospital, Dumka. 2. It is submitted by learned counsel for the petitioner that arrears of salary including salary for February, 2006, pension and arrears of pension, leave encashment of 300 days, provident fund, gratuity are not paid. 3. Learned counsel appearing for the respondents' submitted that a suitable direction may be given to the respondents so that the amount of retirement can be finalised and can be paid to the petitioner. 4. In view of the aforesaid submissions, I hereby direct the concerned respondent authorities to finalise the retirement benefits and they may be paid to the petitioner. The finalization of the amount and payment will be made within a period of eight weeks from the date of receipt of order of this Court. 5. Learned counsel for respondent no. 7 submitted that concerned respondents ought to sign the payment of sanction of arrears of pensionary benefits alongwith service record, service-book of the petitioner to the A.G. Office so that within stipulated time, the completion may be made, therefore, I hereby direct respondent no. 5 to send the necessary papers as stated hereinabove for fixation of the pension to the respondent no. 7, within a period of two weeks from the date of receipt of order of this Court. If this exercise is not completed within aforesaid stipulated time, payment of arrears with interest shall be made @ 10% per annum and initially interest shall be paid by respondent no. 1 and, after, holding inquiry the same will be recovered from erring officer(s). 6. The petition is, accordingly, disposed of.
