ORDER This Civil Revision Petition is filed against the docket order dated 23rd April 2008 passed in I.A. No. 1657 of 2007 in I.A.No.1549 of 2007 in O.S.No.5122 of 2007 passed by VIII Junior Civil Judge, City Civil Court, Hyderabad, wherein the request of the petitioners therein to view the D.V.D. was allowed. 2. The revision petitioners are the defendants and the respondents herein are the plaintiffs in the suit. 3. The respondents herein, who are plaintiffs, filed impugned IANo.1657 of 2007 in O.S.No.5122 of 2007 under Order 17 Rule 14 and Section 151 CPC requesting the court to receive the D.V.D. as additional evidence in the petition. The revision petitioners, who are defendants, resisted the said application contending that nothing was explained as to who prepared, when prepared and with the help of whom and how the said D.V.D is prepared and how it is useful in the evidence and therefore prayed to dismiss the same. The trial court by a docket order allowed the said petition and requested to arrange for play of D.V.D in question. Hence, the present civil revision petition. 4. Heard and perused the impugned order under revision. A perusal of the impugned docket order goes to show that the court below except observing that the grounds are reasonable and the D.V.D in question is required to view for proper adjudication, had not adduced any further reasons to come to such conclusion. Under the above circumstances, the order of the trial court is liable to be set aside and is accordingly set aside. 5. Therefore, this civil revision petition is allowed and the impugned order in IANo.1657 of 2007 in O.S. No. 5122 of 2007 is set aside. However, the court below is directed to dispose of the suit, if not already disposed of, in accordance with law. No costs.
