JUDGMENT : 1. Shri R. S. Solanki, learned Advocate for the applicant. Smt. Mamta Shandilya, learned Panel Lawyer for the respondent/State. 2. Arguments on the first bail application of the applicant Trilok for grant of bail under section 439 of the Criminal Procedure Code heard. 3. The applicant Trilok is involved in Crime No. 215/2009 registered at Police Station Alirajpur, District Alirajpur, for the offence punishable under sections 363, 366 and 376 of the Indian Penal Code. 4. According to the prosecution story, the accused is having some intimacy with complainant and he allured her to marry with him and to go with him to Khargone. On 26-7-2009, complainant went with the accused by bus. They went to Khargone at the house of the friend of the applicant and they stayed there two nights, where accused committed sexual intercourse and denied to marry with her and he left her at Alirajpur and ran away. Hence, the above offence was registered on the report of the complainant. 5. It has been argued on behalf of the applicant that as per the ossification test report age of the prosecutrix is above 18 years. Trial will take time. This is a consent case, hence he should be released on bail. 6. The prosecution has opposed the bail application and it is argued that age of the prosecutrix is 16 years. 7. Considering the circumstances and after perusal of the case diary, the bail application is allowed. It is ordered that the applicant Trilok be released on bail upon his furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the J.M.F.C., Alirajpur for his appearance before the said Court on the dates of hearing as may be fixed in this behalf. M. Cr. C. is, accordingly, disposed of. C. C. today as per rules.
