JUDGMENT : 1. The applicants have filed this revision aggrieved by the impugned order dated 21-4-2009 passed by Additional Sessions Judge, Ganj Basoda in S. T. No. 283/07; whereby rejected the application filed on behalf of the applicants under section 91 of Criminal Procedure Code for production of the previous statements of the witnesses recorded during inquiry by the Police and the dying declaration of the deceased-Sundaribai recorded as panchanama dated 12-5-2007. 2. On consideration of the facts of the case and on perusal of the impugned order, it is apparent that previous statements of the witnesses are admissible for the purpose of omission and contradiction during the cross-examination of the witnesses concerned before the trial Court. Under these circumstances, the learned trial Court ought to have allowed the application and directed the prosecution for production of the aforesaid statements. In view of that, the rejection of the application is found to be erroneous. 3. Resultantly, the revision petition is allowed. The impugned order dated 21-4-2009 passed by trial Court is set aside and the trial Court is directed as under : (1) to direct the prosecution/Police to submit merge statement of the witnesses recorded during inquiry by the Investigating Officer. (2) also to direct to the prosecution produce the alleged dying declaration of the deceased-Sundaribai recorded as panchanama on 12-5-2009; and (3) a report received from the police of Bhopal which is also available in the case diary be also called. (4) after production of the aforesaid documents, an opportunity be given to the applicants for further cross-examination, if any, required by the applicants and thereafter, proceed with the trial according to law. Copy of this order be sent to the trial Court for information and necessary compliance.
