JUDGMENT : 1. Put up on Wednesday, the 28th January 2009. 2. In the meantime, the Municipal Corporation of Delhi shall take over the plant and point out the defects, if any, to the Contractor. 3. The authorities of the Central Pollution Control Board shall, in the meantime, make an inspection of the entire plant, both inside and outside, and shall submit a report to this Court by the next date fixed. 4. We hope and trust that by the next date fixed, the other sections of the abattoir shall also start functioning in terms of the report of the Committee. 5. We also hope and trust that by the next date fixed, the balance payment shall also be made subject to the compliance of the directions as contained in the supplementary report. 6. It is also expected that, in the meantime, the problems in full- fledged running of the plant shall be settled by the concerned authorities of the Delhi Municipal Corporation and the Contractor. 7. Mr. Prashant Kumar, learned counsel appearing for the Contractor states that the warranty period for the plant and machinery being over, the same should be renewed. 8. Mr. Sen, learned counsel appearing for the Corporation assures us that the a decision in that behalf shall also be taken by the next date fixed. 9. The Corporation shall also file compliance report in regard to the payment of tax including the cess in terms of order dated 21st October 2008.
