JUDGMENT Hon'ble SHARMA, J.— The petitioners Sanni Deol and Miss Karishma Kapoor have filed S.B. Criminal Revision Petition No. 249 of 1998 against the order dated Feb. 13, 1998 of the Additional Chief Judicial Magistrate (Railway) Jaipur City, Jaipur dismissing the application for setting aside the order of cognizance dated June 18, 1997 in case No. 1285 of 1997 under Sections 141, 145, 146 and 147 of the Railways Act in FIR No. 9 of 1997 of Police Station GRP Phulera distt. Ajmer under Section 141 of Railways Act and in F.R. No. 4 of 1997 and petitioner Satish Shah has filed S.B. Criminal Revision Petition No. 477 of 1998 against the order dated June 18, 1997 of Additional Chief Judicial Magistrate (Railway) Jaipur City, Jaipur for taking cognizance against the petitioner in Case No. 1285 of 1997 under Sections 141, 145, 146 and 147 of the Railways Act in FIR No. 9 of the 1997 of Police Station GRP Phulera Distt. Ajmer under Sec. 141 of Railways Act and in F.R. No. 4 of 1997. As both these revision petitions relate to Case No. 1285 of 1997 of Additional Chief Judicial Magistrate (Railways) Jaipur, they are being disposed by this common order. 2. As the facts are common, facts of S.B. Criminal Revision Petition No. 477 of 1998 are taken into consideration. The facts in brief are that the petitioners are Film Artists of Film 'Bajrang' and the shooting of this Film took place in village Sanvarda. The Director of the Film wanted to filmised one scene when Train No. 2413 A Up Link Express was going to stop as scheduled at Railway Station Narena. When the train was stopped then the crowd was collected and the crowd did not allow the train to leave the platform. Sita Ram Malakar, Assistant Station Master Railway Station Narena lodged report at Police Station GRP Phulera District Ajmer on 11.3.1997 at 2.15 P.M. as under: ^^Qksu eSlst fnukad 11-3-97 le; 14 Hrs. After investigation the Police submitted final report on May 31, 1997. On June 18, 1997, the Additional Chief Judicial Magistrate (Railways) Jaipur took cognizance against the accused petitioners and one Tinu Verma under Sections 141, 145, 146 and 147 Railway Act. The trial court after taking cognizance issued bailable warrants. Thereafter the trial court converted the bailable warrants into non-bailable warrants. Except accused petitioners Sanni Deol and Karishma Kapoor and co-accused Tinu Verma, accused petitioner Satish Shah appeared before the Court and enlarged on bail. On Feb. 10,1998, the petitioners Sanni Deol and Karishma Kapoor moved an application signed by Shri Arun Shekhawat, Advocate for recalling the order of cognizance dated June 18, 1997 and simultaneously also filed an application for exemption from personal attendance on the ground that petitioner Sanni Deol is out of India in connection with shooting of a Film and the accused petitioner Karishma Kapoor is ill, till next date. The Additional Chief Judicial Magistrate (Railway) Jaipur after hearing arguments on behalf of the accused petitioners Sanni Deol and Karishma Kapoor by a detailed order dated Feb. 13, 1998 rejected the application of the accused petitioners for recalling the order of taking cognizance and the application for exemption from personal attendance and also directed for issuing non-bailable warrants against them. Against this order dated Feb. 13, 1998, S.B. Criminal Revision Petition No. 249 of 1998 was filed by Sanni Deol and Karishma Kapoor before this Court on March 7, 1998. This Court vide order dated March 10, 1998 stayed the execution of order dated Feb. Against this order dated Feb. 13, 1998, S.B. After filing of the Revision Petition No. 249 of 1998, the petitioner Satish shah, filed the above Revision petition No. 477 of 1998 against the order dated June 18, 1997 taking cognizance against him under the various provisions of the Railway Act. 3. At this stage, it is also necessary to have a look at various provisions of the Railway Act, under which cognizance was taken against the accused petitioners. Sections 141, 145, 145 and 147 of the Railway Act, read as under: "Section 141. Needlessly interfering with means of communication in a train. - If any passenger or any other person, wthout reasonable and sufficient cause, makes use of, or interfers with, any means provided by a railway administration in a train for communication between passengers and the railway servant in charge of the train, he shall be punishable with imprisonment for a term which may extent to one year, or with fine which may extend to one thousand rupees, or with both: Provided that, in the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the court, where a passenger, without reasonable and sufficient cause, makes use of the alarm chain provided by a railway administration, such punishment shall not be less than – (a) fine of five hundred rupees, in the caser of conviction for the first offence: and (b) imprisonment for three months in case of conviction for the second or subsequent offence." "Section 145. Drunkenness or nuisance. - If any person in any railway carriage or upon any part of a railway- (a) is in a state of intoxication; or (b) commits any nuisance or act of indecency or uses abusive or obscene language; or (c) wilfully or without excuse interfers with any amenity provided by the railway administration so as to affect the comfortable travel of any passenger, he may be removed from the railway by any railway servant and shall, in addition to the forfeiture of his pass or ticket, be punishable with imprisonment which may extend to six months and with fine which may extent to five hundred rupees: Provided that in the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the Court, such punishment shall not be less than — (a) a fine of one hundred rupees in the case of conviction for the first offence; and (b) imprisonment of one month and a fine of two hundred and fifty rupees, in the case of conviction for second or subsequent offence. "Section 146. Obstructing railway servant in his duties. "Section 146. Trespass and refusal to desist from trespass. - (1) If any person enters upon or into any part of a railway without lawful authority, or having lawfully be punishable with imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both: Provided that in the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the court, such punishment shall not be less than a fine of five hundred rupees. (2) Any person referred to in sub-section (1) may be removed from the railway by any railway servant or by any other person whom such railway servant may call to his aid." 5. The Additional Chief Judicial Magistrate (Railway) Jaipur took cognizance against the accused petitioners as per the provisions of Section 190 of the code of Criminal Procedure, it is necessary to have a look at this provision also. Section 190 Cr.P.C. reads as under: "Section 190. Cognizance of offences by Magistrates. - (1) Subject to the provisions of this Chapter, any Magistrate of the first class, and any Magistrate of the second class specially empowered in this behalf under sub-section (2), may take cognizance of any offence - (a) upon receiving a complaint of facts which constitute such offence; (b) upon a police report of such facts; (c) upon information received from any person other than a police officer, or upon his own knowledge, that such offence has been committed. (2) The Chief Judicial Magistrate may empower any Magistrate of the second class to take cognizance under sub-section (1) of such offences as are within his competence to inquire into or try." 6. I have heard learned counsel for the parties and gone through the material available on record. 7. Mr. A.K. Gupta, learned counsel appearing for the accused petitioners Sanni Deol and Karishma Kapoor and Mr. I have heard learned counsel for the parties and gone through the material available on record. 7. Mr. A.K. Gupta, learned counsel appearing for the accused petitioners Sanni Deol and Karishma Kapoor and Mr. Ashok Gaur, learned counsel appearing for the accused petitioner Satish Shah, contended that the trial court has not properly considered the law and without considering the same observed that first of all they have to appear in person before the court and this fact will be seen at time of reading the substance that any prima facie case is made out or not. The learned counsel contended that the accused petitioners Sanni Deol and Karishma Kapoor put appearance through their counsel and the counsel moved an application on Feb. 10, 1998 to this effect that there is nothing against them for taking cognizance and there was not occasion for the trial court to force the accused petitioners to appear in person first of all and then he will hear the matter on merits that whether prima facie case is made out against them or not. The trial Court is only interested in calling the accused petitioners in person before the Court. The learned counsel argued that from the FIR, it is clear that the accused petitioners have not been named in it and there is no allegation against them that they have committed any offence under any provision of law. The learned counsel argued that the Assistant Station Master Narena lodged the complaint to the effect that the crowd was collected there and the crowd did not allow the train to leave the station in time inspite of signal, given by the employees of Railway. Neither the accused petitioners were present nor they stopped the train and the police submitted a negative report and the order taking cognizance was passed by the trial court is not correct in the eye of law. The trial court has not properly considered this aspect of the case that the Railway Police only registered the case under Section 141 of the Railway Act and the FIR was not registered under Sections 145, 146 and 147 of the Railway Act. There is no iota of evidence to show that there was any obstruction done by any of the accused petitioners at the Railway Station Narena. In support of their submissions, the learned counsel for the accused petitioners placed reliance on Raj Kapoor vs. Laxman ( AIR 1980 SC 605 ), Shahrukh Khan vs. State of Rajasthan and others 2008(1) Western Law Cases (Raj.) 56, K.M. Meher vs. State of Kerala and another ( AIR 1992 SC 2206 ), and Sessions Judge Sawai Madhopur vs. Dashrath Singh (RLW 1996(3) (Raj.) 613). 8. On the other hand, Mr. Piyush Kumar, Public Prosecutor appearing on behalf of the State, contended that the accused petitioners are not above the law. The learned Public Prosecutor drawn my attention towards the order sheets of the trial court. The learned Public Prosecutor opposed the arguments advanced by the learned Advocates Mr. A.K. Gupta and Mr. Ashok Gaur. He has contended that the accused petitioners have entered at the Railway Station Narena without taking prior permission from the authorities concerned. The Assistant Station Master Narena lodged the FIR, stating that the accused petitioners wrongly informed him that they have obtained permission from the higher authorities of the Railways, but same was not submitted by them before him or before any other person. Neither they have produced the sanction to the ASM Narena, nor to the Police nor to the Court. Without any reason they have stopped the Train No. 2413 A Up Link Express at Railway Station Narena for 25 minutes and even after Signal given by the employees of the Railway they have pulled the chain again and again and not allowed the train to start. Sitaram Malakar, ASM, in the first information report stated that film Star of Mumbai working in village Sanvarda pulled chain of Train and stopped the train for 25 minutes. He has stated in his statement under Section 161 Cr.P.C. that the People of Film Industry working in Sanvarda village came at the Plat Form and asked him that they have obtained permission from the higher authorities i.e. from Shri Gandhiji and Shri Bhatnagarji and will stop the train for Shooting, but they have not produced any written permission. At 13.08 Signal was given to the train for 13.09 but directors of the Film Tinu Verma, actress Karishma Kapoor and Hero Sanni Deol and co-actor Satish Shah came at Plat Form and started Shooting and taken and crowd collected and the train could not be started. This statement of Malakar was corroborated by the statement of Shri Som Prakash Gurad of the train, inder Section 161 Cr.P.C. Som Prakash has stated that Camera and other articles used for Shooting was available at the site and Civil Police was also available. Inspite of evidence on record, the Police submitted final report and therefore the Additional Chief Judicial Magistrate (Railway) Jaipur has rightly taken the cognizance under Section 190 Cr.P.C. against the accused petitioner for violation of the provisions of Section 141, 145, 146 and 147 of the Railway Act. The accused petitioners have not even signed the application and only the counsel representing them signed the application for exemption from personal attendance. The Additional Chief Judicial Magistrate in these circumstances rightly rejected the application for recalling the order of cognizance and rejecting the application for exemption from personal attendance and in the order it was clearly mentioned that they are violating the court order. They have moved number of application for exemption from personal attendance. The Additional Chief Judicial Magistrate has rightly ordered for non-bailable warrants because earlier they were summoned by bailable warrants but they failed to appear before the court inspite of number of opportunities as is appeared from the order sheets mentioned above. The learned Public Prosecutor contended that the Additional Chief Judicial Magistrate at the stage of taking cognizance has to see prima facie whether case is made out or not. Because the Assistant Station Master lodged the first information report for taking cognizance and his statement under section 161 Cr.P.C. was corroborated by the Train Guard Som Prakash, the trial Court has rightly rejected the application for recalling the order. The orders of the trial Court are perfectly justified in the eye of law. 9. I have again and again gone through the entire material available on record and the order sheets drawn by the Additional Chief Judicial Magistrate in the file as quoted above, the order taking cognizance against the accused petitioners, subsequent order passed by the Additional Chief Judicial Magistrate on the application dated 10.2.1998 filed for recalling the cognizance order and application for exemption from personal appearance, in my opinion the orders at this stage cannot be interfered with in revisional powers. Any comments at this stage in the matter will prejudice either case of the parties. 10. For these reasons, both the revision petitioners are dismissed. But in the facts and circumstances of the case, following directions are issued in the interest of justice: (a) The warrants issued against the accused petitioners Sanni Deol and Karishma Kapoor will remain stayed till 30 days from today, if they appear before the Additional Chief Judicial Magistrate (Railway) Jaipur and submit personal bail bonds in the amount of Rs. 25,000/- with two sureties in the like amount to the satisfaction of the trial court. (b) If within 30 days the accused petitioners will not submit their bail bonds the Additional Chief Judicial magistrate will be free to issue non-bailable warrants. (c) the accused petitioners shall be free to argue their case at the time of reading the substance of the offence. (d) If the trial Court reaches on the conclusion that substance is made out then the trial Court will proceed further expeditiously. 11. As the main petitions have been disposed the stay applications also stand disposed. The record of the trial Court may be sent forthwith. The interim order issued earlier stands vacated.
