JUDGMENT 1. - Heard learned counsel for the parties. 2. Learned counsel for the accused applicants submits that the learned Magistrate has taken cognizance on the basic of the private complaint and issued warrant of arrest against the accused applicants in the matter of civil nature and the litigation of which is pending in the court of learned Addl. Sessions Judge, Nohar, Distt. Hanumangarh. Learned counsel further submits that in such cases, the complaint can only be filed by the court itself. Learned counsel has also placed reliance on a decision in the case of Mohan Lal v. State of Rajasthan, reported in 2008 (2) Cr.L.R. (Raj.) 1080 , to convert the warrant of arrest into bailable warrant. 3. Having considered the submissions of the learned counsel for the accused applicants and without expressing any opinion on the merits of the case, this bail application is disposed of with the direction that the warrant of arrest issued by the learned Judicial Magistrate, First Class, Nohar vide order dated 24.2.2009 against accused applicants (1) Dula Ram, (2) Naseeb Kaur and (3) Jalandhar Singh shall stand converted into bailable warrant of Rs. 20,000/- each.Bail Application Disposed of as Above. *******
