Judgment Kanwaljit Singh Ahiuwalia, J. 1. Counsel for the petitioner submits that petitioner is facing prosecution under Section 138 of the Negotiable Instruments Act as allegedly a cheque issued by the petitioner for Rs. 1,00,000/- had bounced. Counsel further states that the petitioner is ready and willing to pay the amount of cheque along with reasonable interest and cost. Counsel further submits that petitioner will deposit Rs. 1,15,000/- in the trial Court on the next date of hearing. 2. In case the amount of Rs. 1,15,000/- is deposited in the trial Court, the dispute may be referred by the trial Court to Mediation & Conciliation Center or Permanent Lok Adalat for resolution of the dispute through alternative mechanism. Trial Court, if deem fit, may make its own endeavour. 3. In case the amount is deposited, personal appearance of the petitioner shall stand exempted subject to filing an undertaking that he shall cause appearance as and when required and the evidence recorded in his absence but in the presence of his counsel shall be binding upon him. Trial Court may also specify any other condition in the undertaking to be furnished by the petitioner. On the furnishing of undertaking, the personal appearance of petitioner shall stand exempted. 4. With the observations made above, the present petition is disposed off.
