JUDGMENT The petitioner was working as an Engineer in the fourth respondent Municipality. He filed O.A.No.5547 of 1997 before the Tamil Nadu Administrative Tribunal seeking for a direction to the first respondent State of Tamil Nadu to create the post of Electrician Grade II and subsequently promoting to the said post. 2. The Original Application was admitted on 27. 1997. Even during the pendency of the Original Application, he filed W.P.No.26238 of 2001 for the relief of considering his representation dated 9. 2007. This Court by an order dated 21. 2002 directed the Municipality to consider his case for appointment to the post of Electrician Grade III. By a reply dated 23. 2002, the fourth respondent informed the petitioner that though the petitioner may have all the qualifications to hold the post of Electrician Grade II, the Municipality did not have such a post and therefore his request cannot be considered. 3. The petitioner had not chosen to challenge that communication. In fact the fourth respondent have informed this Court that the petitioner refused to receive the said letter sent to him. Even otherwise, the Tribunal has no jurisdiction to deal with the employments under a Municipal Council. 4. In the light of the above, the Writ Petition stands dismissed. No costs.
