Judgment The petitioner filed O.A.No.5564 of 1997 for a direction to the respondent to regularise her service in the post of Sweeper in the office of the first respondent. On notice from the Tribunal, a reply affidavit was filed by the first respondent dated 211. 1998. 2. In view of the abolition of the Tribunal, the matter stood transferred to this Court and was re-numbered as W.P.No.32110 fo 2006. Paragraph Nos. 3 and 4 of the reply affidavit may be usefully extracted below: "The applicants husband (late) Raman has worked as Sweeper temporarily on daily wages at Karur Police colony and he expired during the year 1980. As his appointment was only temporary only eligible for Family Benefut Fund amount of Rs.10,000/-was paid and other pensionary benefits was not paid as per orders in force at that time. In this vacancy the applicant was appointed on purely temporary basis. The contingent staff are appointed directly and not through employment exchange and as such her services would not be regularised. She used to give petitions in this regard frequently and endorsements were given to her then and there. 4. The version of the applicant in para 6(1) saying that she was appointed on compassionate grounds as Sweeper on daily wages is not at all correct. Her husband (late) Raman was working as temporary daily wage Sweeper only and in the event of his death, the applicant was appointed in the place of temporary daily wage Sweeper only. As the post of daily wage Sweeper is not permanent one, the applicant is not eligible for compassionate appointment. The legal heirs of the permanent Government staff are only eligible for compassionate appointment." 3. In the light of the stand taken by the respondent, the relief claimed by the petitioner cannot be granted by this Court. Hence, the Writ Petition is dismissed. No costs.
