ORDER : 1. Issue notice. 2. Mr. Balraj Dewan, learned counsel accepts notice on behalf of the respondent. 3. There shall be interim stay of the judgments of the High Court in the two cases subject to the condition that the petitioner-Contractor shall keep in all a sum of Rs.75 lakhs out of the amount received from the respondent in Fixed Deposit in a Nationalised Ban k within four weeks and deposit the Fixed Deposit Receipt with this Court’s Registry. 4. The amount in deposit and the interest thereon shall be dealt with as per the final decision in this matter. 5. Counter-affidavit to be filed within eight weeks and rejoinder to be filed within six weeks thereafter. List these matters for final disposal in the month of January, 2010.
