Judgment The prayer in this writ petition is to issue a writ of mandamus, directing the respondents to consider the petitioner for appointment to the post of secondary grade teacher without reference to the age limit prescribed in the Special Rules, by taking into account of the applicants higher qualifications, in view of condition laid down in 12(d)(i) of Tamilnadu State and Sub-Ordinate Service Rules. 2. The petitioner passed +2 in the year 1983, diploma in teacher education in May 1992 registered his name in the employment exchange, Thanjavur on 112. 1992 and he belongs to the backward class community. 3. The case of the petitioner is that the present policy of the Government to appoint secondary grade teacher is issued through G.O.Ms.No.220(School Education) dated 11. 2008. As per the Government Order, secondary grade teachers are directed to be appointed on State wise seniority basis. Now there is no age limit prescribed for appointment of teachers in Government Schools. The person aged 57 years is also eligible to be appointed as a teacher in the State of Tamil Nadu as per the present policy. In view of the same, if the petitioner is not appointed as a secondary grade teacher, till date his claim shall be considered as per the Government Order in G.O.Ms.No.220 (School Education) dated 11. 2008. 4. The writ petition is disposed of accordingly.
