Judgment S.S. Dwivedi, J. : Learned counsel for applicants seeks to withdraw this petition filed under Sec. 482 CrPC aggrieved by the order dated 15.4.2008 passed by XVII ASJ, Indore in Criminal A. No. 25 of 2008 whereby the application filed by the applicants under Sec. 391 CrPC has been rejected. 2. Learned counsel for applicants submits that previously the applicants have not filed the specific application before lower Court stating as to what material they want to examine additionally under the provisions of Sec. 391 CrPC, therefore he wants to withdraw this petition with a liberty to file appropriate application stating the details of the witnesses/documents he wants to produce at the appellate stage under the provisions of Sec. 391 CrPC. 3. Prayer is allowed. The petition is dismissed as withdrawn with a liberty that if the applicants file an appropriate application before appellate Court stating the details of the evidence which they want to produce additionally under the provisions of Sec. 391 CrPC, then Court will consider the application on its own merits and proceed with the case in accordance with law. C.C. as per rules.
