Order This matter had been referred to the Full Bench by order dated 8.11.2006, wherein it was directed to post this matter along with the similar matters pending before the Full Bench of this Court after obtaining permission from the Hon'ble Chief Justice. 2. It is informed by the counsel for the parties that the pending matter referred to earlier before the Full Bench has already been decided by the judgment and order dated 8.8.2007 passed in WP(S) No. 3558/2004 reported in 2007(4) JLJR 36 (Baidyanath Singh VS. The State of Jharkhand & Ors.). 3. This matter, on the aforesaid point, had also been referred to the Full Bench since a similar question, as was involved in the other matters, was pending at that time before another Full Bench. Now that the earlier matter has already been decided, question does not arise for deciding the same controversy by another Full Bench, which is the present one. 4. Hence, the instant appeal is ordered to be remanded before the Division Bench, which obviously will decide the controversy involved in this appeal in the light of the decision already delivered in WP(S) No. 3558/2004 reported in 2007(4) JLJR 36 (Baidyanath Singh VS. The State of Jharkhand & Ors.). 5. The reference is disposed of accordingly.
