JUDGMENT 1. 1. This special appeal is directed against the order dated 19th May, 08 passed by the learned Single Judge of this Court, whereby the writ petition preferred by the respondent assailing the validity of order dated 16.8.07 passed by the Additional Director (Administration), Department of Medical & Health Services, terminating his services has been allowed and accordingly, while quashing the order impugned, the appellants have been directed to reinstate the respondent in service forthwith. 2. The services of the respondent holding the post of Male Nurse were terminated by the order impugned in the writ petition on account of his remaining in police custody for a period more than 24 hours. 3. After perusal of the record produced by the appellants, the learned Single Judge found that it does not disclose any reason as to why the respondent was discontinued from service. The learned Single Judge opined that mere arrest of an employee on account of alleged involvement in a criminal case cannot be a ground to dispense with his services and the order impugned passed by the authority concerned in mechanical manner cannot be sustained. 4. It is not disputed before us by the learned counsel for the appellants that before dispensing with the services of the respondent as aforesaid, no disciplinary proceeding was initiated against him and no inquiry worth the name was ever conducted by the appellants so as to arrive at the conclusion that the retention of the respondent in service is absolutely undesirable. In our considered opinion, the services of the respondent could not have been terminated by the appellants in such a perfunctory manner solely on the ground that he had remained in police custody for a period more than 24 hours. 5. For the aforementioned reasons, we are in complete agreement with the findings arrived at by the learned Single Judge. The order impugned does not suffer from any error warranting interference by us in this intra court appeal. 6. In the result, the special appeal fails, is is hereby dismissed.Appeal Dismissed. *******
