JUDGMENT 1. - By judgment dated 11.10.2008 passed by Additional Sessions Judge, Rajgarh, district Alwar in sessions case no. 26/2004 the appellant applicant Munshi Ram has been convicted under Sections 307, 324, 323, 341 IPC and the maximum term of imprisonment imposed against him is rigorous imprisonment for five years. 2. This is the second application for suspension of sentence of the appellant applicant. 3. Heard learned counsel for the appellant applicant, learned Public Prosecutor for the State and perused the relevant material placed before me. 4. Learned counsel for the appellant applicant submits that the maximum term of imprisonment imposed against the appellant applicant is five years regorous imprisonment and he has already remained in jail for more than 15 months. He further submits that the appeal is not likely to be listed for hearing in near future. He, therefore, prays that the appellant applicant be released on bail.Learned public prosecutor opposes the application. 5. Considering the fact that the appellant applicant has been sentenced to imprisonment for a fixed term and that he has already suffered imprisonment for more than 15 months and after taking into consideration all the facts and circumstances of the case, I am of the opinion that it is appropriate to suspend the sentence of imprisonment awarded to the appellant applicant and release him on bail till the disposal of this appeal. 6. Consequently, the sentence of imprisonment awarded to the appellant applicant shall remain suspended during pendency of this appeal and the appellant applicant Munshi Ram son of Shyo Ram be released on bail provided he deposits the fine and furnishes a personal bond in the sum of Rs. 30000/- with two surety bonds of Rs. 15000/- each to the satisfaction of the trial court with the stipulation to appear before this court on 10.02.2009 and thereafter, whenever called upon to do so. *******
