1. Petitioner states that Respondent Dilla Malik has died three years ago. According to him Dilla Malik was his father, who was residing in the house of his father-in-law Fata who had brought up his daughter as Khana Nishin daughter who was married to Dilla Malik. He has further stated that respondent No:2 is his step brother born from the 2nd wife of his father and other respondents Mohd Hanief and Mohd Din are his real brothers. He has admitted that the matter has been compounded and settled between the surviving parties and he does not want to press the present petition. 2. Although a revision cannot be dismissed as not pressed and the Court has to initially look into the legality or illegality of the impugned order, but when a party getting addressally effected by such orders does not want any decision from the Court, then Court has to withdraw its hands. 3. The present revision petition has been filed against dead person i.e. Dilla Malik. The right to property of the petitioner and other respondents was to flow from Dilla Malik. However, it is noticed that if Dilla Malik had died, still his legal heirs are on the record and as such the revision petition cannot be dismissed simply on the ground that one of the respondent was dead when the revision was filed. 4. Petitioner has admitted that the main dispute was in respect of his step brother Nazar Mohd which has been settled with him. 5. In fact the revision petition is mainly directed in respect of the step brother of the petitioner which has been given the share of property belonging to his father. Once the matter has been settled by the petitioner with his step brother, I deem it proper nor to pass any order in the revision petition because in case of petition is allowed it may spoil the cordial relation between the parties which after a long period of time have become pleasant. The petitioner is also not interested in the disposal of this revision petition and is requesting to dismiss the same. 6. Keeping into consideration the above facts and dispute having been settled by the members of the family, the request of the petitioner is accepted and revision petition is dismissed. 7. File of this Court be consigned to record after due compilation.
