JUDGEMENT 1. This is the second round when the petitioner has come before this court for same direction. 2. Earlier C.W.J.C. No. 4804 of 2009 was filed by the petitioner making the grievance that his appointment against a reserved post for Scheduled Tribe candidate has not been considered by the Selection Committee of the concerned Gram Panchayat. This application was disposed of as the petitioner had already moved for appropriate relief before the appellate authority. The appellate authority was directed to dispose of petitioners applicatin within the statutory time fixed. 3. Counsel for the petitioner submits that direction of this court has intentionally been ignored by the appellate forum. The Mukhiya, in connivance with clerk, Pradeep Kumar Upadhyay, District Teacher Employment Appellate Tribunal. Kaimur, Bhabua has got misplaced his Memo of Appeal. The appellate authority is also reluctant to consider and dispose of his appeal in accordance with law as provided under the rules. 4. This matter is being disposed of. The Chairman of the District Teacher Employment Appellate Tribunal, Kaimur, Bhabua is directed to look into the matter, specially, the allegation made by the petitioner regarding misplacement of his Memo of Appeal at the instance of the clerk of the Tribunal in connivance of the mukhiya of the concerned Gram Panchayat. The appeal preferred by the petitioner must be disposed of considering all relevant aspects of the matter by the appellate forum within 30 days from the date of production/ communication of the order as for disposal of the any appeal under the rules only 30 days time is provided.
