JUDGEMENT 1. Heard learned counsel for the parties. 2. Looking at the nature of the present dispute where one limb is represented by the Union of India and the other statutory authority under the State of Bihar and keeping in mind the several directions which have been issued by the Honble Supreme Court in the matters of such dispute, the Court is of the considered opinion that the two authorities of the kind cannot be allowed to be at logger head. In the dispute of the kind an interference of the Court is not required to settle the issue at this stage. 3. The matter is referred to the Secretary, Department of Energy, Government of Bihar who shall constitute a committee where a representative of the Union of India will also be allowed and the Committee shall render its opinion and resolve the issue between the parties raised in the present writ application. 4. Needless to say that till the dispute is resolved no coercive action will be taken against the petitioner. An early resolution of the dispute is expected in the matter which will be in the interest of both the sides. 5. Let a copy of this order be handed over to S.C.-11 for communication. 6. This writ application is disposed of with the above direction.
