Oriental Insurance Company Ltd v. Anwari Begam

2009-07-08

JAYA ROY, M.Y.EQBAL

body2009
Order Heard Mr. D.C.Ghose, learned counsel for the appellant at length. 2. In this appeal, the appellant who is insurer of the bus has challenged the judgment and award on two grounds, firstly on the quantum of compensation and secondly, apportionment of liability. 3. Admittedly, there is head-on-collusion between the two-wheeler and a bus, which was insured with the appellant-Insurance Company. In our view, the Tribunal has rightly directed the insurer of the bus to pay compensation amount. So far quantum of compensation is concerned, the Insurance Company cannot challenge it. 4. This appeal is, therefore, dismissed. 5. However, the appellant is directed to withdraw the statutory amount, so that compensation amount could be paid to the claimants.
