Judgment Heard Sri Sanjay Prasad, learned counsel for the petitioners and J.C. to Sr. S.C.-I for the respondents. 2. Petitioners in this writ application have prayed for a direction to the respondents to pay to the petitioners salary for the strike period for the year 1999, salary for the month of November, 2000 and also one installment of arrears of salary on the basis of pay revision, which has not been paid. 3. The petitioners were posted as Dresser and Washerman respectively at the Patliputra Medical College and Hospital-cum-Sadar Hospital, Dhanbad. The grievance of the petitioners is that the salary for the period mentioned above was not paid to them inspite of their several representations before the concerned authorities and the notices sent to them through lawyer. It is contended by the petitioners that similarly situated other employees of the same hospital, whose salary for the year 1999 and for the month of November, 2000 was with-held, had earlier moved this Court by filing a writ petition vide W.P.(S) No. 1353 of 2007 and pursuant to the directions contained in the order of this Court, the petitioners’ claim was considered by the respondents and the grievance of the employees was redressed. 3. In its counter affidavit, the Respondent No. 3 namely the Superintendent, Patliputra Medical College and Hospital, Dhanbad has admitted and acknowledged the claim of the petitioners that the salary for the strike period for the year 1999, salary for the month of November, 2000 and arrears of pay revision has not been paid to the petitioners. It is further sought to be explained that the arrears of salary could not be made on account of paucity of funds since the allotment of funds was not forthcoming from the State of Bihar at the relevant time. 4. From the admitted facts, the claim of the petitioners being not disputed, the non-payment of salary merely because the funds were not made available from the erstwhile State of Bihar does not appear to be convincing or reasonable. The petitioners are admittedly employed in the hospital which is situated within the State of Jharkhand and as informed at the Bar, as per the terms of understanding between the two State Governments, the State of Jharkhand has undertaken the responsibility to pay the arrears of salary to the Government employees. 5.

Considering the aforesaid facts and circumstances, this writ application is disposed of with a direction to the Respondents to consider the claim of the petitioners and pass an appropriate order in accordance with law, within a period of six weeks from the date of receipt/production of a copy of this order. The Respondent No. 3 shall assess the amount payable to the petitioners by way of their salary and other monetary benefits and shall ensure payments of the same within one month from the date of decision taken on the petitioners’ claim, together with statutory interest. With these observations, this writ application is disposed of. Let a copy of this order be given to the learned counsel for the respondent State.
