JudgmentJudgment Surya Kant, J. 1. The petitioner seeks a direction to the police authorities to take action against respondents No. 2 and 3 - HDFC Bank and its authorities for their alleged act of taking physical possession of truck bearing registration No. PB23-F-5799 belonging to the petitioner and hypothecated with the respondent Bank. 2. Notice of motion was issued and in response thereto, learned counsel for the respondent Bank points out that the petitioner has consistently defaulted in payment of twelve monthly installments of Rs. 30,800/- each. In this manner, he is liable to pay a sum of Rs. 3,69,000/-. 3. Learned counsel for the petitioner submits that if some reasonable time is granted, the petitioner is willing to clear all the dues and shall also continue to pay the monthly installments in time. 4. In order to show his bona-fide, the petitioner is ready and willing to pay Rs. 60,000/- without any delay. 5. Having heard learned counsel for the parties and taking into consideration all the attending circumstances, I am of the considered view that while the petitioner deserves to be granted some reasonable period to clear the dues, the respondent Bank also needs to have sufficient security to recover the amount. 6. Consequently, it is directed that subject to the petitioner paying a sum of Rs. One Lac within two weeks and furnishing adequate security of immovable property valuing at least double the amount due, along with title deeds, to the satisfaction of the respondent Bank, the truck in question shall be released forthwith. 7. The petitioner shall continue to pay the monthly installments regularly. 8. Disposed of. Dasti.
