JUDGMENT : Rajiv Sharma, J. The grievances of the petitioners are that their services have not been taken over by the State Government after taking over of Public Senior Secondary School, Dharampur (Madhan). Mr. R.K. Sharma, learned Senior Additional Advocate General has drawn the attention of the Court to Notification dated 31.3.1996 and submits that it is not a case of taking over, but in fact, it is a case of up-gradation. As per letter dated 31st March, 1996 Government High School, Dharmapur (Madhan) was upgraded to Senior Secondary standard and not taken over. Since the State Government has not taken over any privately managed Public School, there is no question of taking over the services of the staff. It is only in those cases where the schools are taken over, the services of teaches and ministerial staff are taken over and in those cases where the school is upgraded, there is no question of taking over the services of the privately managed school (See Civil Appeal Nos. 6211-6212 of 1997 titled State of Himachal Pradesh & Ors. v. Harvinder Singh & Ors. decided on September 10, 1997). 2. Accordingly, in view of the judgment rendered by the Apex Court in Harvinder Singhs case (supra) there is no merit in the petition and the same is accordingly dismissed. There will be no order as to costs.
