Judgment :- 1. I have heard the learned Counsel for the parties. 2. The point in issue in this writ petition is covered by a decision of this Court in W.P.Nos. 22235 to 22256/2010 disposed of on 15.9.2010 between ANIL KUMAR K.C. & OTHERS VS. THE VICE CHANCELLOR & OTHERS. 3. In the light of the said order, the impugned notices at Annexures ‘K’ and ‘N’ dated 4.1.2010 and 6.2.2010 are treated as show cause notices calling upon the petitioner as to why the degree certificate issued to him earlier should not be withdrawn. The petitioner is granted three months from today to file his objections to the show cause notices. The University shall not take back the original marks cards from the petitioner pending disposal of the inquiry. The Enquiry Committee of the University is directed to hold an enquiry and submit its recommendations to the Register of the University. Thereafter, the competent authorities of the University are directed to pass appropriate orders in accordance with law. The petitioner is permitted to produce the attested copy of the marks card in case the Enquiry Committee needs them. The Statement said to have been forcibly taken by the University from the petitioner earlier, shall not be taken into account at the time of holding the enquiry. It is needless to say that the Enquiry Committee has to hear the petitioner while holding the enquiry as above. Writ petition is disposed of accordingly. No costs.
