Judgment :- M. Chockalingam, J. Invoking writ jurisdiction of this Court, one Kairunnisa has brought forth this habeas corpus petition stating that her daughter by name S. Parveen, aged about 17 years, was found missing from 19.1.2010. She did not come from the Company on 19.1.2010, where she was working. A complaint was given to the respondent-police, specifically stating that she was being kidnapped by one Gopi. Though a case was registered by the respondent-police, she has not yet been traced. 2. When the matter was taken up for enquiry on 4.3.2010, it was represented by the learned counsel appearing for the State that a case in Crime No.132 of 2010 was registered for "Girl Missing" under Section 366 A of the Indian Penal Code and investigation is on. 3. This day, when the matter is taken up for enquiry, the detenue is produced before this Court. When she was enquired, she stated that she was born on 19.1.1994 and she married the said Gopi on 27.1.2010 in Shiva temple and she is now living with him. She is not willing to go with her mother/petitioner, who is present in Court. 4. After hearing the learned counsel for the petitioner and looking into the facts and circumstances of the case that she is a minor, without going to the validity or otherwise of the alleged marriage with the said Gopi, which took place on 27.1.2010, it is fit and proper to issue direction that the detenue has to be kept at Home viz. the Superintendent, Government Observation Home for Girls, Purasawalkam High Road, Kelleys, Chennai – 600 010 till she attains majority. Registry is directed to take steps in that regard. The Habeas Corpus Petitin is closed.
