ORDER : 1. Order passed by this Court on 12.1.2010, State of Assam vs. Union of India, (2010) 9 SCC 274 is recalled and the same be read as follows: Mr. Justice S.N. Variava, former Judge of the Supreme Court of India, was appointed as the Chairman of the Local Commission vide order dated 25.9.2006. Mr. Justice S.N. Variava expressed his personal difficulties in continuing with the Commission and a letter dated 26.12.2009 to this effect was sent. Mr. Justice S.N. Variava is hereby relieved of his duty as Chairman of the Local Commission appointed by this Court. 2. As per this Courts order Mr. Justice S.N. Variava was entitled to all facilities which are provided to a sitting Judge of this Court, including secretariat allowances wherever required. We are told that Mr. Justice S.N. Variava had not submitted any bills so far claiming remuneration or any other benefit. 3. As the work of the Local Commission is not yet over, we hereby appoint Hon'ble Mr. Justice Tarun Chatterjee, a retired Judge of this Court as the Chairman of the Local Commission and Mr. Kamal Naidu, Retired Principal Chief Conservator of Forests, Andhra Pradesh and Mr. S.P. Goel, Additional Surveyor General of India, as its members. 4. The Chairman as well as the members may continue on the same terms and conditions as per the order of this Court dated 25.9.2006, State of Assam vs. Union of India, (2010) 9 SCC 277 . 5. We are told that this Commission will have to sit for a few more sittings to complete the work. The State concerned shall provide all facilities for carrying out the work smoothly of the Commission. 6. Send a copy of this order to Hon'ble Mr. Justice Tarun Chatterjee and also to the members. The Commission is requested to take over the work at the earliest. The initial term of the Commission is fixed for a period of one year from the date of the first sitting. 7. List after three months.
