JUDGMENT 1. - Heard learned counsel for the parties. 2. The learned counsel for the petitioners has submitted that informant Jagvir son of Ramhans Gurjar has specifically stated in the first information report that petitioner No.3 Bhobal was armed with farsi and he had inflicted injury on the deceased. Further he has submitted that in the statement before the trial court Jagvir PW-1 has stated that Bhobal had inflicted injury on the deceased by lathi. According to him, there is drastic change in the version of the informant for the reason that allegation made in the report did not find support in the medical evidence on record. As regards petitioner No.1 Mahavir, he has submitted that the first version given by Jagvir PW-1 in the report lodged by him, no specific over act has been assigned to Mahavir son of Petam. Similarly, that allegations against petitioner No.2 Siyaram are not very specific. Therefore, the petitioners may be enlarged on bail. 3. Learned Public Prosecutor as well as learned counsel for the complainant have opposed the bail application and submitted that all the petitioners have been named in the first information report and looking to the facts and circumstances of the case, they may not be enlarged on bail. 4. Having given my thoughtful consideration to the submissions made by the rival parties and on careful examination of the material on record and without expressing any opinion on the merits of the case, I deem it just and proper to enlarge petitioner No. 1 Mahavir and petitioner No.3 Bhobal on bail. So far as petitioner No.2 Siyaram son of Petam is concerned, no case for grant of bail is made out in his favour at this stage. 5. Consequently, this bail application is partly allowed. The bail application of petitioner No.1 Mahavir and petitioner No.3 Bhobal is allowed and that of petitioner No.2 Siyaram is rejected. It is ordered that the accused- petitioners Mahavir son of Petam and Bhobal son of Bhulli in F.I.R. No. 176/2009, registered at Police Station Khatumar, Alwar shall be released on bail; provided each of them furnish a personal bond of Rs. 50,000/- and two surety bonds of Rs.
