Judgment : N. Ananda, J: The petitioner is arrayed as accused no. 1 in Crime No. 14/2010 registered by Karnataka Lokayuktha Police, Mysore for offences punishable under Sections 7 and 13 (1)(d)(ii) readwith 13(2) of Prevention of Corruption Act, 1988. He has sought for Anticipatory Bail. 2. The petitioner (Sub-Registrar of Mysore Urban Development Authority, Mysore) is alleged to have demanded and received the bride amount from the first information as a motive or reward to register a document of sale in favour of the first informant. 3. Heard learned Counsel for petitioner and Sri. Rajendra Reddy – learned Counsel for respondent – Lokayuktha. 4. The trap mahazar discloses that the bride amount (tainted currency notes) has to be recovered from the possession of accused No. 1 and a sum of Rs. 1,200/- was recovered from accused No. 2 who is said to be a private agent operating in the office of the Sub-Registrar, MUDA, Mysore. The petitioner was neither apprehended in his office nor he ran away from his office. The petitioner went home after completing office hours. Therefore, without going into further details, the direction sought for is granted for a limited period of enable the petitioner to seek regular bail. 5. In the result, I pass the following: Order Petition is accepted. Petitioner is granted anticipatory bail, subject to following conditions: 1) If the petitioner is arrested in Crime No. 14/2010 of Karnataka Lokayuktha Police, Mysore District, registered for the offences punishable under Section 7 of Prevention of Corruption Act, 1988, he shall be released on bail on his executing a bond for a sum of Rs. 1,00,000/- offering a surety for the like sum. 2) Petitioner shall not intimidate or tamper with the prosecution witnesses. 3) Petitioner for the purpose of investigation, shall appear before the Investigating Officer, whenever called upon to do so. 4) This order would be operative for a period of two months from today within such time, petitioner shall seek regular bail before the jurisdictional Court. In such an event, the learned Judge of the jurisdictional Court shall consider bail application without being influenced by observations made in this order.
