JUDGEMENT Rakesh Kumar and j. JJ. 1. After some argument, learned counsel for the petitioner seeks permission to withdraw this application. Prayer is allowed. 2. Accordingly, the petition is dismissed as withdrawn. 3. In this case, by order dated 8.10.1999, while admitting the case, this Court had directed that pending hearing of this application, further proceeding in Sessions Case No.22 of 1996 pending in the court of Sri Birendra Kumar, 3rd Additional Sessions Judge, Bhagalpur shall remain stayed and order of stay is still continuing. 4. In view of rejection of the present petition, the interim order of stay stands automatically vacated. Let a copy of this order be sent to the court below forthwith. In this case, as per order of this Court, original case diary was received, which is lying with the record of the case. Since the petition has been dismissed, office is directed to remit back the case diary to the court below.
